I've seen this bike for over a week now just sitting infront of the Dubliner in Fremont. It's not locked up and several times I've seen it just laying on the ground. It's in sad shape, missing and broken spokes. But the frame is not bad, probably a 53CM. Anyone looking for an old clunker to fix up should go excersise some karma and give it a better home.

nishiki is still there rode by it twice today but i didnt lock it up or snag it.
it looks in rideable condition.
someone go grab it. last thing i need is one more bike in my apartment

I got kicked out of the Dead Babies for "stealing" an unlocked bike.
Nikki at Mobius considers 'liberating" a bike a sin against all that is holy and basically won't even talk to me. Never mind that every other Dead Baby has stolen a bike. Some even admit it freely!

aaron, didn't you take an unlocked bike from inside a building? and then get in trouble for leaving it unlocked on the street and letting it get stolen?
there are a few shades of grey in between your black and white there.

99.9% sure this bike was stolen and then abandoned. It's in bad shape, rusty and broken spokes. So if taking it, fixing it up and getting it to someone who will ride it is bad karma, then I don't know what's good.
It's not locked and it's been sitting/laying in the same spot for over 2 weeks.
Did anyone take that bike? Because I just went to rescue it and it was gone. So sad!

Since I used to own the bike station, and knew the workings of the place, I had assumed the bike was a bike that was left on a Metro bus. Bikestation has the contract to hold and reunite the lost bikes left on busses. only about 5 or 10% are ever returned. The rest, mostly beat up BMX (rusty, no brakes, no grips, flat tires, etc) and department store junk get "donated" to places like Bike Works or Sharing Wheels or charity like that. So, I assumed it was one of those. I am not justifying doing it, just saying. Yeah, it was dumb and of course I had never, nor would again do something like that. I paid for my mistake by giving the owner $300 cash and a vintage Schwinn 2-Speed kick-back 26" middle weight girls bike in near mint condition. Easily worth $500. Needless to say, when I found out the bike belonged to someone, I was mortified, ashamed and glad to make amends. Ain't being human fun?

Not according to Niki. According to her it is NEVER ok. Ironically she supports the Dead Babies, and after this incident, I found out that many DBs have stolen or "liberated" bikes.
As for liberating bikes, the proper way to do it would be to report it to the city/police, they would come impound it, then after much red tape and several months it would probably get auctioned off. I say if someone leaves their bike out on a public street for more than a week, the deserve to have it liberated. Hell, you can't even leave your car for more than 3 days on a public road. It isn't a storage unit, it is a thoroughfare! However, I think we can all determine when a bike is abandoned. I did it once to a bike that was locked outside my apt. It was there all winter. Finally I unbolted the street sign and lifted the ulocked wreck off. Turns out not a single part on the bike was good!

Some related Statutes:
Maritime Law (as I encountered on the Gulf Coast) requires a 30 day waiting period, after which unmoored vessels can be claimed as salvage and reliscenced. e.g. If, after a hurricane, a boat is blown out of the marina and into the salt marsh, wait a month and then it's up for grabs.
Adverse Possession (squatting) In the state of Washington. If one continuously inhabits, improves, and pays taxes on a piece of land for seven years, it belongs to them.
The point is, private property is only so private. There should be a swift, just, and legal procedure for claiming abandoned bikes. (locking them and providing your number, oiling bikes left in the rain, a short-term waiting period, etc.) Maybe one day, we'll all agree on a procedure.
Untill then, two suggestions: DON'T LEAVE YOUR BIKE OUT IN THE U-DISTICT! and BIKE THIEVES SHOULD BE PUBLICLY STRIPPED, SHAVED, AND BRANDED.
