Last week on my way home from work crossing Mercer Island, I stopped at a light next to another cyclist. He proceeded to topple over while trying to clip out of his Look pedals.
After watching to make sure he hadn't injured anything other than his pride, I proceeded to act like nothing happened.
I got to thinking about the times I had had clipless prat falls, and how I wish people had reacted.
When you fall over and make an ass of yourself in public, how do you want people to act?

Usually people just laugh at me, but then again it's usually .83'ers and I only fell over because of extensive intoxication.
I'm remebering back to a state pooper-trooper harassing me from his bullhorn when I fell over by Safeco a few weeks back. that was good times.

i had the best slomo fall a while back when out riding with andre, he watched the guys across the intersections as their heads tilted over to watch me fall. it was pretty embarassing.

to be fair that was the time your seatpost failed though right? so you kind of fell off the bike but your feet were still attached. I really did miss it since you were just behind me. The two guys across the street moved their heads in unison then both winced when you landed. I looked back and say you pinned by your bike.

ive talked to some copper friends of mine while they were off duty... they think that they can give bikes DUI's, they didnt have a clue. not many people know about that WA state law that gives us a loophole.

Yeah like we have noted before it varies by state and in some places it is a DUI. The cop is not the one to argue that with though, save it for a judge. I've pretty much made up my mind that whatever assumptions driver, peds, cops, cyclists have about rules of the road or laws when they go out are not going to change on the road.

Actually, the cop has to list an RCW or KCHC, etc. when they ticket you, otherwise the ticket is null and void and you can ignore it.
As for riding drunk, well it is not illegal.

Intoxicated bicyclists.
(1) A law enforcement officer may offer to transport a bicycle rider who appears to be under the influence of alcohol or any drug and who is walking or moving along or within the right of way of a public roadway, unless the bicycle rider is to be taken into protective custody under RCW 70.96A.120. The law enforcement officer offering to transport an intoxicated bicycle rider under this section shall:
(a) Transport the intoxicated bicycle rider to a safe place; or
(b) Release the intoxicated bicycle rider to a competent person.
(2) The law enforcement officer shall not provide the assistance offered if the bicycle rider refuses to accept it. No suit or action may be commenced or prosecuted against the law enforcement officer, law enforcement agency, the state of Washington, or any political subdivision of the state for any act resulting from the refusal of the bicycle rider to accept this assistance.
(3) The law enforcement officer may impound the bicycle operated by an intoxicated bicycle rider if the officer determines that impoundment is necessary to reduce a threat to public safety, and there are no reasonable alternatives to impoundment. The bicyclist will be given a written notice of when and where the impounded bicycle may be reclaimed. The bicycle may be reclaimed by the bicycle rider when the bicycle rider no longer appears to be intoxicated, or by an individual who can establish ownership of the bicycle. The bicycle must be returned without payment of a fee. If the bicycle is not reclaimed within thirty days, it will be subject to sale or disposal consistent with agency procedures.

Of course, I don't know if the RCWs follow RFC 2119 style key words. Has anyone actually tried to test this is court?

The list describes things that the officer may do instead of nothing at all when dealing with a drunk cyclist. If the officer doesn't do one of them, then they can't legally do anything else, provided that the cyclist isn't doing something other than just riding around drunk. The law couldn't possibly spell out all of the things an officer must not do in every circumstance, only what they can do.
In any case, it's irrelevant, because if they want to ticket you, they're going to, no matter what the law says.

Now that is true! My friend Val (Bikesmith) got a ticket in Renton. The cops there seem to want to pull him over for riding in the road. He once got a ticket and the cop made up an RCW! MADE IT UP! The judge did throw it out, but still!

i distinctly remember a conversation with a drunk ass outside of the mustard seed (who was a cop) involving him telling us all that if he was on duty, we'd all get DUIs. then we left. good times.

my roomate is an EMT, and had a conversation with a city prosecuter and a sheriff, because he was convinced cyclists could get DUIs. both of the other guys told him he was wrong.

maybe the point being missed here is this little technicality called "probable cause".
This opens the door for all sorts of trouble, whether justified or not.
I'm not caffeinated enough to go into details, but those of you who have intimate dealings with the police KNOW that once they can justify a reason to stop you then it's all over but the cryin!
